Settlement reached in Lepanto sports complex lawsuit

The Lepanto City Council, in a special called meeting Tuesday night, agreed to a settlement with Jancour Construction.

Mayor Steve Jernigan said he, along with City Attorney Noyl Houston and City Clerk Tamara Wyatt, met with representatives of Jancour last week for mediation in the lawsuit. Though no agreement was reached during mediation, Jernigan said the talk opened the door for further negotiation since then, and a number had been agreed upon for a settlement.

On Houston's recommendation, the council agreed to a settlement with Jancour in the amount of $18,500. The council also approved a motion to transfer the money from the Water Department account to pay the settlement. The Water Department account will be repaid with interest from the Park Operations and Maintenance fund starting in October of 2015 when the park lights are paid off.

The lawsuit was brought against the city by Jancour after the council approved in 2011 to pay $106,654.97 for the completion of the sports complex and did not include $34,250 Jancour requested for 137 days of work done after the agreed upon completion date of March 17, 2010.
